Interesting article, don't you think? My comment on the article is that
it appears generalized on a federal level as each state has their own rules and
regulations regarding insurance premiums. For example, in Texas, the Major
Insurance companies have to petition the state for permission for rate
increases. In my experience, I have seen rates drop upon renewal for some
customers. While the Kathy Kristof, the Author, is a respected Financial Writer,
and Robert Hunter is director of insurance at Consumer Federation of America,
the article does say to check our your own State for more details. In fact, it
warns you to do more investigation than make your decision on price alone. Your
claims experience is, after all, why you have the insurance. In short, while
this article may apply to some states exactly as written, in my opinion, it
doesn't for the state of Texas. All insurance companies in Texas are required to
use the same policy and there are heavy restrictions on discounts. Premiums in
Texas are not negotiable. My clients not only get a stable company backing their
claims, but the service on an Agent, me, that has former claims experience that
will come in handy if there is a claim. In addition, my Agency contributes to
charity and donates to the community. There is more to consider than premium
alone.<br />

President Barack Obama is set to sign into law a bipartisan bill relieving
homeowners living in flood-prone neighborhoods from big increases in their
insurance bills.<br />
<br />
The legislation, which <a href="http://www.insurancejournal.com/news/national/2014/03/13/323273.htm">cleared
Congress on Thursday</a>, reverses much of a 2012 overhaul of the government’s
much-criticized flood insurance program after angry homeowners facing sharp
premium hikes protested.<br />
The Senate’s 72-22 vote sent the House-drafted measure to Obama. White House
officials said he’ll sign it.<br />
The bill would scale back big flood insurance premium increases faced by
hundreds of thousands of homeowners. The measure also would allow below-market
insurance rates to be passed on to people buying homes in flood zones with
taxpayer-subsidized policies.<br />
<br />
Critics say Washington is caving to political pressure to undo one of the few
recent overhauls it has managed to pass.<br />
<br />
“While politically expedient today, this abdication of responsibility by
Congress is going to come back and bite them and taxpayers when the next
disaster strikes,” said Steve Ellis, vice president of Taxpayers for Common
Sense, a Washington-based watchdog group. “Everyone knows this program is not
fiscally sound or even viable in the near term.”<br />
<br />
The hard-fought 2012 rewrite of the federal flood insurance program was aimed
at weaning hundreds of thousands of homeowners off of subsidized rates and
required extensive updating of the flood maps used to set premiums. But its
implementation stirred anxiety among many homeowners along the Atlantic and Gulf
coasts and in flood plains, many of whom are threatened with unaffordable rate
increases.<br />
<br />
The legislation offers its greatest relief to owners of properties that were
originally built to code but subsequently were found to be at greater flood
risk. Such “grandfathered” homeowners currently benefit from below-market rates
that are subsidized by other policyholders, and the new legislation would
preserve that status and cap premium increases at 18 percent a year. The 2012
overhaul required premiums to increase to actuarially sound rates over five
years and required extensive remapping.<br />
<br />
Many homeowners faulted the Federal Emergency Management Agency’s
implementation of the 2012 law. In some instances, homeowners from areas that
had never been flooded were shocked and frightened by warnings of huge,
unaffordable premium increases. The resulting uproar quickly got the attention
of lawmakers and peppered them with complaints.<br />
<br />
“In many cases, these are people with $100,000 homes that are getting (flood
insurance) bills that are more than their mortgage payments,” said Rep. John
Fleming, R-La. “You had certainly a significant number of people who were really
going to be hurt seriously through no fault of their own.”<br />
The top leaders of both parties came on board, overcoming resistance from
defenders of the 2012 overhaul like House Financial Services Committee Chairman
Jeb Hensarling, R-Texas, whose turf was trampled along the way.<br />
“Members on both sides of the aisle and a broad geographic distribution got
involved. And when you get enough members involved, it’s going to get the
attention of the leadership, and that was a major factor,” said Rep. Charles
Boustany, R-La.<br />
<br />
Another provision, eagerly sought by the real estate industry, would allow
sellers of older homes built before original flood insurance risk maps were
drafted to pass taxpayer-subsidized policies on to the people buying their homes
instead of requiring purchasers to pay actuarially sound rates immediately, as
required by the 2012 law. The new rates are particularly high in older coastal
communities in states like Florida, Massachusetts and New Jersey, and have put a
damper on home sales as prospective buyers recoil at the higher, multifold
premium increases.<br />
The measure also would give relief to people who bought homes after the
changes were enacted in July 2012 and therefore faced sharp, immediate jumps in
their premiums; they would see those increases rolled back and receive rebates.
Separate legislation by Sen. Mike Lee, R-Utah, would make sure that rebates
would not go to recent buyers of beach houses and other second homes. It passed
the Senate Thursday and is likely to get a vote in the House.<br />
<br />
“While it is important to put this program on sound financial footing,
middle-class families should be able to afford the insurance they need to stay
in their homes,” White House spokesman Bobby Whithorne said.<br />
Thursday’s bill was written by House Majority Leader Eric Cantor, R-Va., and
Rep. Michael Grimm, R-N.Y., with input from Democrats like Rep. Maxine Waters of
California, whose votes were critical to House passage last week.<br />
<br />
“We’ve solved a very short-term problem and made it a long-term problem,”
said Sen. Tom Coburn, R-Okla. “We didn’t really do our work because we were in
such a hurry to take the political pressure off of the increases in the flood
insurance rates.”<br />

People whose second home is in a flood zone and those whose properties have
flooded repeatedly would continue to see their premiums go up by 25 percent a

Flooding can occur as streams and rivers overflow their banks, when dams or levees break, with run-off from deep snow cover, or any time there is rainfall with significant duration and intensity.<br />
<br />
<b>Keep these facts in mind to stay alive and dry.</b><br />
1. Flash floods can come suddenly. They can occur within a few minutes or hours of heavy rainfall, or when a dam or levee fails and even a sudden release of water held by a debris jam. Be cautious during storms, or any time that flooding is common<br />
2. Drive slowly as you may not have warning that a flash flood is approaching. <br />
3. Stay home and don't drive unless necessary. <br />
4. Do not drive through flooded areas. If you see a flooded road, turn around and find another route. <br />
5. If there is no other travel route, get to higher ground and wait for the waters to subside. <br />
6. Even if the water looks low enough to cross, don't attempt it. Water hides wholes in the road. Even worse, there may be no road at all under the water. Flooding can wash away the entire road surface and a large amount of ground beneath. <br />
7. If your car stops running, get out of it immediately and to higher ground. <br />
8. As little as six inches of water can flood the bottom of most passenger cars, causing loss of control and or stalling. <br />
9.One foot of water will float almost many vehicles. <br />
10. As much as two feet of water can wash away most vehicles — including SUVs and trucks. <br />

The website for Americans to buy insurance under President Barack Obama's health
care law should be working smoothly for most users by the end of November, a
White House official assigned to fix Healthcare.gov said Friday. <br />
Jeffrey Zients told reporters in a conference call that Quality Software
Services Inc., or QSSI, will serve as a general contractor to oversee the
repairs.<br />
The administration has not had a technology company overseeing the entire
project. Instead, the government decided early on that the Centers for Medicare
and Medicaid Services, part of the U.S. Department of Health and Human Services,
would serve as the system integrator.<br />
The company, a unit of health insurer UnitedHealth Group Inc., already has a
technology contract related to the website and testified on Thursday to a
congressional panel about problems with the system.<br />
QSSI produced the federal data hub and a software tool for creating online
consumer accounts, which was at the center of early logjam problems.<br />
Online insurance exchanges were launched on Oct. 1 under the 2010 Patient
Protection and Affordable Care Act, often called "Obamacare," to offer health
insurance plans to millions of uninsured Americans. But many Americans have
experienced error messages and long waits in trying to sign on to
Healthcare.gov, which has become a political embarrassment for President
Obama.<br />
"By the end of November, the vast majority of consumers will be able to
successfully and smoothly enroll through Healthcare.gov," Mr. Zients said. <br />

<strong>'A lot of problems'</strong></h4>
Mr. Zients said he had brought in technology experts to establish the
problems with the website and to prioritize the repairs. Based on that
assessment, he described Healthcare.gov as being "fixable."<br />
"It will take a lot of work and there are a lot of problems that will need to
be addressed, but the bottom line is that it is fixable," he said. </div>

He said experts had identified "dozens of items" to be fixed in terms of both
performance and functionality, and said a problem related to communications with
insurers was on the top of the list. He did not provide further details about
the nature of the glitches.<br />
Earlier this week, the government told insurers in a meeting that it was
working to fix data transmission problems with applications and also with the
technology that can allow insurers to directly enroll consumers in exchange
plans.<br />
The government expects about 7 million people to enroll for individual
insurance in 2014, many of whom are expected to receive government subsidies.
Consumers must enroll by mid-December to have insurance on Jan. 1 and by the end
of March 2014 if they want to avoid paying the penalty laid out in the
Affordable Care Act.<br />
About 90% of people who try to create accounts are able to do so, but the
ability to complete an application has been "volatile," Mr. Zients said. The
government said that about 700,000 Obamacare applications had been filled out
across the country but has not provided enrollment figures.<br />
The federal government is running the website for 36 states while 14 other
states have built their own exchanges to sell insurance policies under
Obamacare. Some state sites have also had technology issues.<br />
Republican lawmakers, long opposed to Obamacare, have pounced on the rocky
rollout to launch multiple investigations into the administration's missteps and
the role of contractors.<br />
Some Democrats have also criticized the administration and called for
extending the open-enrollment period beyond the existing March 31 deadline.<br />
Two committees in the Republican-controlled House of Representatives will
hold hearings next week, one with Health and Human Services Secretary Kathleen
Sebelius and another with Marilyn Tavenner, administrator of the Centers for
Medicare and Medicaid Services.<br />
The White House said last week that President Obama still has "full
confidence" in Ms. Sebelius, whose department is responsible for implementing
the law. </div>

<b>I've had an auto accident, now what do I do?</b><br />

I get this question a lot, espcially after someone has left the scene of an accident. So, this information should come in handy before or if you have an auto accident.<br />
<br />
1. Check to see if anyone is injured, either in your auto, or the other autos. Document the injuries.<br />
2. Call "911" for the police to come to the scene, and am ambulance, if someone is hurt. You will be asked by the 911 operator if anyone is injured and my suggestion is to answer that you "don't know". Simply, because you don't know if anyone will feel pain or soreness later on, and, the policy will take longer to come to the scene if no injury is reported.<br />
3. Take photos of the scene, damages to the all cars, passendgers, drivers, etc. The goal is to document everything to be reviewed later. Of course, get the insurance and id information from all other drivers, and name of passengers.<br />
4. Collect names and phone numbers of any witnesses. A witness could be a key deciding factor on fault. Sometimes, if the accident happens on private property, the policy will not come out to the scene so your witnesses will really be important to you then.<br />

What is a Texas SR22 filing and where do I get one? Many people think that when they need an SR22, it is a special kind of insurance but that is wrong. An SR22 is an Insurance Certificate of Financial Responsibility. Often, Texas may require a driver to secure an SR22 due to driving offenses such as a crash, judgement or conviction (think Driving While Intoxicated (DWI), several speeding tickets, reckless driving, etc.).<br />

An SR22 is a Certificate that an Insurance Company will provide stating the insured has an auto insurance policy with at least the minimum limits. The auto insurance carrier will keep the state informed of the status of your auto insurance policy were it to cancel or lapse. It is the law in Texas to carry and maintain the minimum liability coverage of $30,000 for death or bodily injury per person, $60,000 for death or bodily injury per occurrence, and $25,000 for property damage done to others. With out such a policy, driving privileges may be suspended or revoked.<br />

Many carriers will offer an SR22 so all you would have to do is inquire. However, many carriers will cancel your auto insurance policy if they find out you need one as it may indicate to them of risky driving behavior. The companies that do offer an SR22, you might be able to get a good rate before of if you are convicted of an offense. Usually, if convicted, your rates would be affected for the reason of requiring an SR22. If you are already in the policy term, the rate would be affected at renewal, not at the time of obtaining the SR22.<br />
<br />
You shouldn't carry more than one auto insurance policy so if you have one in affect with a carrier that doesn't provide an SR22, you would need to change auto insurance carriers. If you don't own a vehicle, you can purchase a "non owners" policy with an SR22 filing.<br />
<br />
Sometimes, you may require a temporary SR22 while your case is being reviewed. If not convicted of a driving offense, then only a small charge may be applied to the premium of a carrier that will issue an SR22. The SR22 filing can be canceled with proof from the court that an SR22 is no longer needed.<br />

What happens when a neighbors tree limb or tree falls on my car or on my home? Well, I have the answer. I get this question all the time from all over Texas so here is how your insurance would apply as well as liability.<br />
<br />
If a neighbors tree or tree limb falls on your car, or home, it would be "your" insurance that takes care of the damage, minus your deductible. Even though the limb is from a tree that belongs to your neighbor, and you feel that your neighbor was negligent in some way by not trimming the limb, you would need proof that the neighbor knew the tree was dead or diseased, and proof that you had asked the neighbor to trim the limb on several occasions by copies of certified letters sent to them and/or photos of the tree/limb. This will not guarantee that your neighbors insurance company would pay for the damages to your auto or home, nor would it guarantee that a court would find your neighbor negligent, but it would be the only course of action you could attempt to get your damages paid for by our neighbor or your neighbor's insurance short of small claims court.<br />
<br />
If the limb falls on your car and causes damages to your car (or your windshield only), your comprehensive (other than collision) would be the coverage on your auto policy that would apply (if you have the coverage). You may want to consider the cost of the repairs compared to your comprehensive deductible because your deductible may be more than the cost of the repairs. If this is the case, you want to reconsider placing a claim to ensure the claim would not affect your rates. If you don't have comprehensive coverage on your policy, the damages would be paid for out of your own pocket.<br />
<br />
If your neighbors tree or tree limb falls on your home, your home insurance policy would cover this damage, minus your deductible. You may want to compare your homeowners deductible to an estimate of repairs before you place a claim as the cost of repairs may below your deductible. If you don't need to place a claim, then don't to ensure the claim would not affect your rates. However, as in the example of a tree or tree limb falling on your car, you would need proof that your neighbor knew the tree was dead or diseased and you had copies of certified letters showing you had requested the neighbor to remove the risk to your property. Again, this won't guarantee you coverage by their insurance but would be the only avenue you could take.<br />
<br />
Consider asking your neighbor to share the cost of cutting down the limb or even paying for it by yourself. It might be cheaper than an insurance deductible. I have a neighbor who had a pine tree limb hanging over my driveway and he gladly allowed me to pay to have it trimmed.<br />
